1. Introduction

At Claisen, Inc. (“Claisen,” “we,” “us,” or “our”), your privacy and the security of your personal and health information are fundamental to our mission. This Privacy Policy explains how we collect, use, protect, and share your personal information—including Protected Health Information (PHI)—when you use our digital health services, including our personalized gut-health care kits, online health quizzes, and other features (collectively, the “Services”).


We understand that your health information is sensitive and deserves the highest level of protection. That’s why we’re committed to using the minimum necessary standard to access, use, and disclose PHI, as required by the Health Insurance Portability and Accountability Act of 1996 (HIPAA) (45 CFR §164.502(b)). This policy is designed to comply with HIPAA, the Federal Trade Commission Act (FTC Act), and applicable state privacy laws, including the California Consumer Privacy Act (CCPA), the California Confidentiality of Medical Information Act (CMIA), and other relevant state-specific privacy regulations. It covers all information we collect directly from you, automatically through technology used in our Services, and from trusted third-party partners (such as pharmacy and telehealth providers) who assist in delivering your care.


By using our Services—whether through our website, mobile applications, customer support channels, or other tools—you acknowledge and agree to the practices described in this Privacy Policy. If you are using the Services on behalf of another individual, you confirm that you are authorized to act on their behalf and that they understand and accept the practices outlined in this Privacy Policy. If you do not agree with this Privacy Policy, please discontinue use of our Services.

Your trust is essential to us. We are committed to using your information only to provide and improve your personalized care experience, to securing your data through comprehensive technical and organizational safeguards, and to giving you clear choices and control over your personal information.

This Privacy Policy does not apply to third-party providers (such as telehealth doctors or pharmacies) who deliver care directly to you. They have their own privacy practices under HIPAA and other applicable laws. However, Claisen requires that all partners handling PHI on our behalf sign Business Associate Agreements (BAAs) in accordance with HIPAA’s requirements (45 CFR §164.504(e)).


2. Limitations on Use by Minors

The Claisen Services are designed for use by adults aged eighteen (18) years or older, or the age of majority in their jurisdiction of residence, whichever is older. Our Services are not directed to children under thirteen (13), and we do not knowingly collect personal information from children under thirteen (13). If we discover that we have inadvertently collected personal information from a child under thirteen (13), we will promptly delete that information from our records in accordance with applicable laws.

If you are between the ages of thirteen (13) and eighteen (18) (or the applicable age of majority), you may only use the Claisen Services under the supervision of a parent or legal guardian who has reviewed and agreed to this Privacy Policy on your behalf. In these cases, your parent or legal guardian may act as your “personal representative” under HIPAA (45 CFR §164.502(g)) and exercise rights regarding your Protected Health Information (PHI) on your behalf. However, we do not encourage use of the Services by minors due to the sensitive nature of health assessments, lifestyle guidance, and access to PHI. We reserve the right to restrict or deny access to minors at our discretion.

If you are under eighteen (18) years of age—or the parent or legal guardian of such a minor—you may request removal of content or personal information about you that has been posted on our platform. We will not accept requests via phone or fax and are not responsible for incomplete, incorrectly labeled, or incorrectly submitted requests.

Please note that we may not be able to erase or eliminate information in certain circumstances, including when:

  • Federal, state, or local law requires us to maintain the content or information

  • The information is part of your medical record maintained by a covered entity or business associate (such as a pharmacy or telehealth provider); in these cases, we will attempt to redirect your request accordingly

  • The information was posted by a third party (not you)

  • We have de-identified the data, making it no longer personally identifiable

  • You did not follow the above instructions or have received compensation for the information

These practices are consistent with the Children’s Online Privacy Protection Act (COPPA) and other applicable laws. However, this section is not an admission that Claisen is subject to COPPA or similar minor-specific privacy laws in all cases. By using Claisen’s Services, you affirm that you meet these age requirements and understand these limitations.

3. Information We Collect

Claisen collects a range of information to deliver personalized gut-health care kits and to continually improve our Services.

A. Information You Provide Directly

When you engage with Claisen—such as by creating an account, filling out our health quiz, ordering your gut-health care kit, or contacting our customer support team—you provide us with information that includes:

Personal Identifiers:

We collect basic identifying details to help us know who you are and to ensure we can deliver your personalized care:

  • Full name

  • Date of birth

  • Mailing address (for shipping and billing)

  • Email address (for communication and account notifications)

  • Phone number (for important updates, delivery coordination, and support)

Health and Lifestyle Data:

Central to Claisen’s approach is understanding your gut-health concerns, symptoms, and lifestyle factors. We gather this data through your responses to our comprehensive online health quiz, as well as through ongoing interactions with our team. This includes:

  • Current and past symptoms

  • Personal and family health history relevant to gut-health and digestion

  • Dietary habits, food triggers, and lifestyle factors (such as stress or exercise routines)

  • Treatment preferences or past experiences with certain therapies or supplements

  • Any other information you voluntarily provide about your health or wellness goals

Communications:

Whenever you reach out to Claisen—whether by email, phone, live chat, or survey response—we collect and store these interactions to provide effective customer service and to ensure continuity of your care plan. This includes:

  • Content of your messages (questions, feedback, concerns)

  • Technical support or troubleshooting inquiries

  • Survey responses or reviews you share about your experience

Payment and Transactional Information:

To process and fulfill your orders, we collect payment-related information, though we do not store full payment card numbers ourselves. Instead, these are handled by trusted third-party processors. Specifically, we collect:

  • Partial payment card details (e.g., last four digits) to facilitate support or verify transactions

  • Billing address to validate purchases

  • Order history and details to ensure accurate fulfillment of your personalized care kits

Account Information:

When you create an account on Claisen’s platform, we collect the information needed to create and maintain your secure profile, such as:

  • Username

  • Password and security questions (encrypted and protected by industry-standard security practices)

Account preferences you set within your Claisen profile

B. Information We Collect Automatically

As you use Claisen’s website and digital tools, we collect certain information automatically to help us understand usage patterns and improve our Services.

Device and Technical Information:

We gather details about the devices and browsers you use to access Claisen, including:

  • IP address and approximate geographic location (city, state)

  • Device type (computer, smartphone, tablet)

  • Operating system, browser type, and version

  • Language settings and system configurations

Usage Data:

We track how you navigate and interact with Claisen’s digital tools, such as:

  • Pages viewed and features used on our website or health quiz

  • Time spent on specific pages or resources

  • Clickstream data (which pages you enter from and go to next)

  • Date and time stamps of your interactions

  • Referring URLs (the site you came from before visiting Claisen)

Cookies and Tracking Technologies:

We and our partners use cookies, web beacons, pixel tags, and similar technologies to collect information about your activity on Claisen’s website. These help us:

  • Remember your preferences and quiz progress

  • Provide personalized recommendations based on your browsing patterns

  • Analyze site performance and usage trends

  • Enhance security and prevent fraud

Geolocation Data:

Depending on your device settings, we may collect data about your general location to personalize content or suggest region-specific resources.

C. Information from Third-Party Sources

We sometimes receive information about you from trusted third-party partners to complete your personalized care experience. For example:

  • Fulfillment Partners: We work with licensed pharmacy partners and logistics providers to ensure that your monthly kits are delivered accurately and on time. These partners may share data about shipping status, delivery updates, or related operational information.

  • Telehealth Partners: If you use telehealth services through our platform, we may receive information from providers who review your quiz responses and make personalized care recommendations.

  • Analytics and Marketing Vendors: We may receive aggregate insights from analytics tools (e.g., Google Analytics) about how users interact with our site, to help us refine and improve our offerings.

  • Public or Social Sources: If you engage with Claisen through public forums, reviews, or social platforms, we may collect and store information about those interactions. You may have the option to limit or control this sharing by adjusting your privacy settings on those external platforms or by contacting us at privacy@claisen.com.

We do not collect biometric data (such as facial scans, fingerprints, or voiceprints).

D. Sensitive Health Data and PHI

Certain data you provide—like your symptom details, health history, and lifestyle data—may be considered Protected Health Information (PHI) under HIPAA when linked to your identity and used for the provision of care. We treat this data with the highest level of security and confidentiality, and we handle it in accordance with HIPAA’s Privacy Rule and Security Rule (45 CFR Parts 160 and 164). For instance:

  • Any health data used by Claisen solely for your treatment, payment, or healthcare operations is treated as PHI and subject to HIPAA’s strict protections.

  • We do not use or share your PHI for marketing without your explicit, written consent (45 CFR § 164.508).

  • PHI that has been de-identified according to HIPAA’s standards (45 CFR § 164.514) is no longer considered PHI and may be used for research, analytics, or product development.

Some of the information we collect, like dietary habits or lifestyle data, may also be considered “sensitive personal information” under state laws such as the California Consumer Privacy Act (CCPA) and will be handled with heightened care and transparency.

E. Your Choices

You always have choices about the information you provide to Claisen. If you choose not to share certain data or provide incorrect information, some features of the Services may not be available to you, or you may not receive the full benefit of our personalized gut-health care kits and guidance.

4. How We Share Your Information

We share your personal information, including any health information that qualifies as Protected Health Information (PHI), only as permitted or required by law and solely for purposes that support your care and our operational needs. Claisen’s sharing practices are fully aligned with the HIPAA Privacy Rule (45 CFR Part 164), the FTC Act, and other applicable state and federal laws.

When you use our Services, we may share your information with trusted partners who play a direct role in delivering your personalized care. For example, we work with licensed pharmacy partners, such as Truepill, to fulfill your personalized gut-health care kits, and we rely on logistics providers like ShipBob for shipping and delivery. When telehealth services are involved, we may share your information with telehealth providers who assess your needs and recommend treatment plans. We also engage cloud-based vendors, such as Amazon Web Services (AWS), to securely store and manage your data. Each of these partners is bound by strict confidentiality and security requirements, and those that handle PHI on our behalf are required by law to sign Business Associate Agreements (BAAs) with us, as mandated by HIPAA (45 CFR § 164.504(e)).

We may also share your information in limited circumstances as required by law, such as in response to a valid court order, a regulatory inquiry by the Department of Health and Human Services (HHS), or other legally authorized requests. In these instances, we ensure that any disclosures are strictly limited to the “minimum necessary” standard as defined by HIPAA (45 CFR § 164.502(b)).

Additionally, we may disclose information when we believe it is necessary to investigate or prevent fraud, ensure the security and integrity of our systems, or protect the health and safety of our users and the broader public. Such disclosures are done in accordance with HIPAA’s permitted uses and disclosures for serious threats to health or safety (45 CFR § 164.512(j)).

If Claisen undergoes a corporate transaction, such as a merger, acquisition, or sale of assets, your information may be transferred as part of that transaction. However, we ensure that any such transfer complies with this Privacy Policy and applicable legal protections. We will provide notice if these circumstances result in your information becoming subject to new or different privacy practices.

We will never sell your PHI or other sensitive health data. Additionally, we do not share your PHI with third parties for their own marketing purposes without your explicit, written authorization (as required by 45 CFR § 164.508). Any use of PHI for marketing—beyond core service-related communications—will only occur with your express written consent.

When sharing information that has been de-identified in compliance with HIPAA’s de-identification standard (45 CFR § 164.514), it is no longer considered PHI. We may use or share this de-identified information for research, analytics, or service improvement in ways that do not identify you personally.

In all cases, Claisen’s sharing practices prioritize your privacy and trust, ensuring that your information is shared only to the extent necessary to provide high-quality care and operate responsibly within the framework of applicable health privacy laws.

5. Your Rights and Choices

At Claisen, we believe that your health and personal data belongs to you, and we are committed to respecting your rights and providing you with clear, accessible ways to exercise them. Depending on whether your data is subject to the Health Insurance Portability and Accountability Act of 1996 (HIPAA), the California Consumer Privacy Act (CCPA), or other applicable privacy laws, you have important rights over how your information is accessed, corrected, shared, and managed.

Under HIPAA and other applicable laws, you have the right to:

  • Access your PHI that we maintain in our records. This includes the information you provided in our health quizzes, your order history, and any notes or updates linked to your treatment and care preferences (45 CFR § 164.524).

  • Request amendments to your PHI if you believe it is incomplete or inaccurate (45 CFR § 164.526).

  • Request restrictions on how we use or disclose your PHI. While we are not always required to agree, we will consider these requests carefully (45 CFR § 164.522(a)).

  • Request confidential communications, such as having us contact you at a specific phone number, mailing address, or email address (45 CFR § 164.522(b)).

  • Receive an accounting of disclosures of your PHI outside of treatment, payment, and healthcare operations (45 CFR § 164.528).

  • Obtain an electronic copy of your PHI (if it is maintained electronically), in line with the HITECH Act (42 U.S.C. § 17935(e)).

For California residents and others protected by state-specific laws like the CCPA or CPRA, you also have the right to:

  • Know what personal information we have collected about you, the sources of that information, how it is used, and the categories of third parties with whom it is shared (Cal. Civ. Code §§ 1798.110, 1798.115).

  • Request deletion of your personal information, subject to important legal exceptions (such as data retention for compliance, fraud prevention, or care-related reasons) (Cal. Civ. Code § 1798.105).

  • Opt out of “sales” of your personal information as defined by state law (note: Claisen does not sell your PHI or sensitive health data).

  • Limit the use of “sensitive personal information” (e.g., health-related data or lifestyle data) for purposes beyond what is necessary to deliver the Services (Cal. Civ. Code § 1798.121).

  • Exercise data portability rights to obtain a copy of your information in a readily usable format.

To exercise any of these rights, please contact us at privacy@claisen.com or submit your request by mail to our Privacy Officer. In some cases, we may need to verify your identity before fulfilling your request and may ask for additional information to do so in a secure and confidential manner.

Please note there are circumstances in which we may be required or permitted by law to deny your request, such as when data must be retained to comply with legal obligations, prevent fraud, or maintain the integrity of our clinical records. If we deny your request in whole or in part, we will provide a clear explanation of the reasons and inform you of any available appeals process.

Claisen will not discriminate against you for exercising any of your privacy rights. We are committed to treating all users equally and respectfully, regardless of the privacy choices you make.

6. Cookies and Tracking Technologies

At Claisen, we use cookies and other tracking technologies to enhance your experience on our website, improve our Services, and better understand how you interact with our platform. These technologies help us remember your preferences, understand your browsing habits, and ensure that our website and digital tools work smoothly and securely.

When you visit our website, we may use cookies to remember your login details (if applicable), save your quiz progress, or personalize your experience based on your interactions. In addition to first-party cookies that we place directly, we may also use third-party cookies set by trusted partners like analytics providers and service vendors. For example, we use tools like Google Analytics to measure how users engage with our site so that we can continue to improve the design and functionality of our Services.

If we ever combine cookie or device tracking data with PHI (such as linking usage patterns to your health profile), we treat this combined data as PHI under HIPAA (45 CFR §160.103), applying the same heightened protections as for your sensitive health information.

You have choices when it comes to cookies and tracking technologies. Most web browsers allow you to control or disable cookies through your browser settings. You can usually find these options in your browser’s preferences or settings menu. Please note that disabling cookies may impact your ability to fully use certain features of our website or access personalized content.

We also recognize signals from certain browser privacy features, such as the Global Privacy Control (GPC), and will honor them to the extent required by applicable law, including the CCPA/CPRA. However, other browser signals like Do Not Track (DNT) are not yet standardized, and we do not currently respond to them.

7. Data Security Measures

Protecting your personal and health information is a core commitment at Claisen. We have implemented a comprehensive security program that aligns with the HIPAA Security Rule (45 CFR §§ 164.302–318), the FTC’s data security guidance, and industry best practices to safeguard your information from unauthorized access, use, or disclosure.

Our security measures include administrative, physical, and technical safeguards. We use encryption standards that meet or exceed industry best practices—such as AES-256 encryption for data at rest and TLS 1.2+ for data in transit—to ensure that your sensitive data remains secure. Access to your information is strictly controlled using role-based permissions and multi-factor authentication (MFA) wherever possible, ensuring that only authorized personnel can view or handle sensitive data.

Claisen also maintains robust policies and procedures to guide our employees and contractors on data privacy and security. We provide regular training to ensure that our team understands and follows best practices, including the specific protections required for PHI under HIPAA.

We conduct regular Security Risk Assessments (SRAs) and vulnerability scans to identify and address potential threats to the confidentiality, integrity, and availability of your information. If we identify any significant risks or vulnerabilities, we take prompt and decisive action to resolve them.

Despite our best efforts, no security program is perfect. If we discover a data breach that involves your personal or health information, we will notify you in accordance with HIPAA’s Breach Notification Rule (45 CFR §§ 164.400–414) and state-specific breach notification laws (such as Massachusetts M.G.L. c.93H for residents of Massachusetts, which requires prompt notice to the state Attorney General and affected individuals). We will also report significant breaches to the U.S. Department of Health and Human Services (HHS) when required.

8. Data Retention and Deletion

Claisen retains personal information and PHI for as long as necessary to provide our Services, comply with legal obligations, resolve disputes, and enforce our agreements, consistent with our obligations under HIPAA (45 CFR § 164.530(j)) and other relevant laws.

For PHI specifically, HIPAA requires us to retain certain records for a minimum of six (6) years from the date they were created or last used, whichever is later. This includes records related to your personalized gut-health care kits, your health quiz data, and any communications you have with us about your care. State laws or specific business needs may require us to retain certain types of information for longer periods.

When data is no longer needed, we follow rigorous procedures to ensure it is securely deleted or de-identified. Data that is de-identified in accordance with HIPAA’s de-identification standards (45 CFR § 164.514) is no longer considered PHI and may be used or shared for analytics, research, or product development.

If you are a California resident or otherwise have specific rights under applicable state laws, you also have the right to request deletion of your personal data (subject to important legal exceptions, such as when retention is required by law or needed for legitimate business purposes). Additionally, under the CCPA/CPRA (Cal. Civ. Code §1798.100(d)), you have the right to data portability, meaning you can request a copy of your personal information in a readily usable format.

We are dedicated to transparency and will clearly communicate with you about the status of your request and any legal requirements that may affect it.

9. Marketing and Personal Communications

At Claisen, we recognize the importance of clear, respectful communication with our customers. Our primary focus is to use your personal and health-related information to deliver and support your personalized gut-health. In certain circumstances, we may also use your information to communicate with you about new products, services, special offers, and updates that we believe may be relevant or of interest to you. However, we are deeply committed to respecting your preferences and complying with all applicable laws—including HIPAA’s specific restrictions on the use of PHI for marketing.

Under HIPAA (45 CFR § 164.508), we will not use or disclose your Protected Health Information (PHI) for marketing purposes without your explicit, written authorization. This means we do not—and will not—sell or share your PHI with third parties for their own marketing efforts. We also will not send you marketing messages that use your PHI unless you have specifically authorized us to do so. This ensures that your sensitive health information is used only to support your care and deliver the products and services you’ve requested.

However, we may use your personal information that is not considered PHI under HIPAA (such as your name and email address) to send you communications about Claisen’s own products, services, and updates. For example, we may send newsletters or notifications about new gut-health supplements, resources, or tips to help you manage your symptoms. We do this based on our legitimate interest in engaging with you as a valued customer, in full compliance with applicable laws and your stated preferences.

You always have the choice to opt out of receiving these promotional communications. Every marketing email or SMS message we send will include clear instructions on how to unsubscribe. You can also opt out at any time by emailing us at privacy@claisen.com or using the unsubscribe options in your communication. Please note that opting out of marketing communications will not affect your ability to receive important transactional messages related to your care or orders, such as shipment updates or order confirmations.

If you have given us explicit authorization to use your PHI for marketing, you may revoke that authorization at any time by contacting us. We will honor your revocation in a timely manner, consistent with HIPAA’s Privacy Rule and our internal policies.

At Claisen, we believe that marketing communications should be clear, relevant, and fully respectful of your privacy. We will never use your health-related data for marketing in a way that conflicts with your rights or violates our obligations under HIPAA, the FTC Act, or state-specific privacy laws.

10. Jurisdictional Issues

Claisen’s Services are designed and intended for use within the United States. All information that we collect, store, or process—including any health-related or personal data—is governed by U.S. federal and state privacy laws, including the Health Insurance Portability and Accountability Act of 1996 (HIPAA), the Federal Trade Commission Act (FTC Act), and state-specific privacy regulations such as the California Consumer Privacy Act (CCPA) and the California Confidentiality of Medical Information Act (CMIA).

By using Claisen’s Services, you consent to the collection, processing, and storage of your personal information in the United States, regardless of your location at the time you use the Services. We do not currently offer Services outside of the United States, and we do not actively market our Services to residents of countries with different or conflicting data privacy regimes, such as the European Union’s General Data Protection Regulation (GDPR).

If you choose to access or use our Services from outside the United States, you acknowledge that your information will be transferred to and processed in the U.S., where privacy protections may differ from those in your home jurisdiction. While we strive to uphold high standards of privacy and security, your use of the Services indicates your consent to these practices.

11. California and State-Specific Rights

If you are a California resident or reside in another state with specific data privacy laws, you have additional rights regarding your personal information under statutes like the California Consumer Privacy Act (CCPA), the California Confidentiality of Medical Information Act (CMIA), and similar state frameworks. Under the CCPA, you have the right to:

  • Know what categories of personal information we collect about you, the sources of that information, how we use it, and the categories of third parties with whom we share it (Cal. Civ. Code §§ 1798.110, 1798.115).

  • Request access to or deletion of your personal information, subject to important legal exceptions (such as data needed for compliance, fraud prevention, or clinical care) (Cal. Civ. Code § 1798.105).

  • Opt out of “sales” of personal information as defined by California law (note: Claisen does not sell your PHI or other sensitive health data).

Before processing certain requests, we may need to verify your identity to ensure the security of your data. Depending on your request and applicable law, we may require additional information to confirm your identity and process your request in a timely and secure manner.

In addition to the rights provided by the CCPA, the CMIA provides specific protections for health-related information collected and maintained by us and our partners. Under the CMIA, your health-related information cannot be used or disclosed without your authorization, except as permitted by law for treatment, payment, or essential health operations.

For residents of other states—including, but not limited to, Colorado, Virginia, and Connecticut—you may also have rights to access, correct, delete, or limit the use of your personal information, consistent with those states’ privacy laws. Claisen is committed to extending these protections to all our users whenever feasible and required by law.

12. Miscellaneous

At Claisen, we strive to implement reasonable physical, technical, and administrative safeguards to protect your personal and health information from unauthorised access, use, disclosure, alteration, or destruction. Please note, however, that some features of the Services may require specific personal or health data to function properly, and declining to provide it may limit your ability to fully benefit from the personalized nature of our gut-health care kits and services. You also have the option to opt out of receiving marketing communications by following the unsubscribe instructions in those messages or by contacting us directly. However, please understand that even if you opt out of promotional emails, we may still need to send you important transactional messages relating to your care or our Services, such as order confirmations and shipment updates.

Currently, Claisen does not respond to web browser “Do Not Track” signals or similar mechanisms that provide a general opt-out for online behavioral tracking across different websites. If we implement support for such signals in the future, we will update this Privacy Policy to reflect how we honor those requests.
